These Terms of Service ("Terms") govern your use of BioShield Decon's biohazard remediation services. By engaging our services, you agree to these Terms. Please read them carefully.

1. Services Provided

BioShield Decon provides professional biohazard remediation services including:

  • Trauma scene cleanup (crime scenes, unattended deaths, suicides, accidents)
  • Biohazard removal and disposal
  • Decontamination services
  • Infectious disease sanitization
  • Related remediation and restoration services

All services are performed in accordance with OSHA, EPA, and Arizona state regulations.

2. Service Agreement

Estimates and Pricing

  • Initial estimates are provided based on available information and may be adjusted after on-site assessment
  • Final pricing depends on the scope of work, materials required, and time needed
  • We provide transparent pricing and will notify you of any significant changes before proceeding
  • Emergency services may incur additional fees for immediate response

Authorization

  • You must be the property owner or have legal authority to authorize services
  • For rental properties, landlord authorization may be required
  • Law enforcement clearance is required for crime scenes before work can begin
  • Written authorization may be required for certain services

Property Access

  • You agree to provide safe and legal access to the property
  • You are responsible for securing pets and removing valuables from work areas
  • We are not responsible for items not removed from the work area prior to service
  • Access delays may result in rescheduling fees

3. Payment Terms

  • Payment is due upon completion of services unless other arrangements are made in writing
  • We accept major credit cards, checks, and insurance direct billing
  • A deposit may be required for large projects
  • Late payments may incur interest charges at the maximum rate allowed by Arizona law
  • You are responsible for payment regardless of insurance coverage or claim status
  • Disputed charges must be raised within 30 days of invoice date

4. Insurance Claims

While we assist with insurance documentation:

  • We provide detailed documentation to support insurance claims
  • We can communicate directly with insurance adjusters with your authorization
  • Insurance coverage and claim approval are between you and your insurance company
  • You remain responsible for payment even if insurance denies or partially covers the claim
  • We are not responsible for insurance company decisions or delays

5. Scope of Work

  • We perform only the services explicitly agreed upon in the service agreement
  • Additional contamination or damage discovered during work may require additional services and costs
  • We are not responsible for pre-existing conditions unrelated to the biohazard situation
  • Structural repairs, painting, and general restoration are not included unless specifically contracted
  • We do not provide crime scene investigation or forensic services

6. Warranties and Guarantees

Service Guarantee

  • We guarantee our work meets or exceeds industry standards and regulatory requirements
  • All biohazardous materials will be properly removed and disposed of per regulations
  • Treated areas will pass verification testing (ATP or other appropriate methods)
  • We will re-treat any areas that fail verification at no additional charge

Limitations

  • We cannot guarantee complete odor elimination in all cases (porous materials may retain odors)
  • We are not responsible for damage caused by the original incident
  • We cannot guarantee against future contamination or incidents
  • Some materials may require removal rather than cleaning

7. Liability and Indemnification

Our Liability

  • We maintain comprehensive liability insurance for our operations
  • We are responsible for damage directly caused by our negligence during service delivery
  • Our liability is limited to the amount paid for services or our insurance coverage limits, whichever is less
  • We are not liable for pre-existing damage, damage from the original incident, or consequential damages

Your Responsibilities

  • You agree to indemnify us against claims arising from your failure to disclose known hazards
  • You are responsible for ensuring legal authority to authorize services
  • You agree to follow all safety instructions and post-service recommendations
  • You acknowledge the inherent risks of biohazard situations

8. Cancellation and Rescheduling

  • Emergency services: 4-hour notice required to avoid cancellation fee
  • Scheduled services: 24-hour notice required to avoid cancellation fee
  • Cancellation fees may apply to cover mobilization costs
  • We reserve the right to reschedule due to weather, equipment issues, or safety concerns
  • If we cancel, no fees will be charged

9. Confidentiality

We maintain strict confidentiality regarding all service details. We will not disclose information about your situation except as required by law or with your explicit written consent. See our Privacy Policy for complete details.

10. Safety and Compliance

  • All work is performed in compliance with OSHA, EPA, and state regulations
  • Our technicians are trained and certified in bloodborne pathogens and hazardous waste handling
  • We use only EPA-registered disinfectants and approved disposal methods
  • You agree to follow all safety recommendations and reoccupancy guidelines
  • Premature reoccupancy may void warranties and create health risks

11. Dispute Resolution

Informal Resolution

We encourage you to contact us directly with any concerns. Most issues can be resolved through direct communication.

Formal Disputes

  • Any disputes will be governed by Arizona law
  • Disputes must be filed within one year of the service date
  • Mediation is required before litigation
  • Venue for any legal action is Maricopa County, Arizona

12. Emergency Services

For emergency services:

  • We provide 24/7 emergency response
  • Emergency response times are estimates, not guarantees
  • Weather, traffic, and other factors may affect response times
  • Emergency services may require immediate authorization and payment arrangements
  • We prioritize life-safety emergencies

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised date. Your continued use of our services after changes constitutes acceptance of the modified Terms. Terms in effect at the time of service apply to that specific service.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15. Entire Agreement

These Terms, together with any written service agreement and our Privacy Policy, constitute the entire agreement between you and BioShield Decon regarding our services.
